Eligibility and Accounts

Nonabanana Images provides tools for generating and editing images using AI models and related infrastructure.

  • Be responsible for any text, images, prompts, or other content you submit to the Services ("User Content").

You agree that you will not:

  • Use the Services to create or distribute content that is illegal, harmful, harassing, defamatory, hateful, discriminatory, sexually explicit, or otherwise objectionable.
  • Attempt to reverse engineer, probe, or circumvent any security or technical measures of the Services.
  • Misrepresent generated content as being created without AI assistance where such disclosure is legally required.
  • Use the Services to train or improve competing models without our prior written permission.

We reserve the right (but have no obligation) to review or disable access to content that we reasonably believe violates these Terms.

Ownership and License

Our rights

All rights, title, and interest in and to the Services, including the underlying software, models, and infrastructure, are owned by Nonabanana Images or its licensors. Except for the limited rights expressly granted in these Terms, we do not grant you any intellectual property rights.

Your content and outputs

  • You retain any rights you have in the prompts, reference images, and other User Content you submit.
  • Subject to your compliance with these Terms and payment of any applicable fees, we grant you a license to use, reproduce, and display the images and assets generated for you by the Services ("Outputs") for your own projects and business purposes, except where specific model providers impose additional restrictions.
  • You are responsible for ensuring that your use of Outputs complies with applicable laws, third‑party rights (such as copyright, trademarks, and privacy rights), and any additional model‑specific terms that we disclose.

If you provide feedback, ideas, or suggestions about the Services, you grant us a non‑exclusive, worldwide, royalty‑free license to use that feedback without obligation or compensation to you.

Payments and Subscriptions

Certain features of the Services may be offered on a paid basis (for example, credits, subscriptions, or usage‑based billing).

  • By starting a paid plan, you authorize us and our payment processors to charge the applicable fees to your chosen payment method.
  • All fees are stated exclusive of any taxes or duties unless otherwise noted. You are responsible for any applicable taxes.
  • Unless otherwise specified, fees are non‑refundable to the fullest extent permitted by law.

Limitation of Liability

To the maximum extent permitted by law, Nonabanana Images and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Services.

In all cases, our total liability arising out of or relating to the Services will be limited to the greater of (a) the amounts you paid to us for use of the Services in the 3 months preceding the event giving rise to the claim, or (b) one hundred (100) US dollars.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Indemnification

You agree to indemnify and hold harmless Nonabanana Images and its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services, your User Content or Outputs, or your violation of these Terms.
